Description: Appellate and first instance decisions arising from a large and complex multi-party dispute from a capital raising for New Cap Reinsurance. The issues in the case straddled the capital raising provisions in the Corporations Act and the Trade Practices Act, as well as directors’ duties at common law and pursuant to statute.
